The service lady tricks me into exceeding the 14-day Widerrufsrecht

Timeline as follows:

18.02.2020 An external salesman (Außendienst) came to my apartment and persuaded me to sign the contract ''2play Fly 400 Unitymedia''.

 

21.02.2020 The Vodafone-Station (router) arrived and was successfully installed. Everything seemed ok then. But after a few days, I found some problems. In brief, one is the unstable signal, and another is high Ping and package loss during online games.

 

05.03.2020 I E-mailed the external salesman to cancel the contract but he replied to me that he can only sign the contract but cannot cancel the contract. Sounds reasonable.

 

06.03.2020 (Friday) I call the Widerruf-Hotline to make the cancelation. The service lady asked me why and I explained the reasons mentioned above.

Service lady: We can send you a technical expert.

Me: I do not need a technical expert. I just simply want a cancelation.

Service lady: But you say that there are technical problems and a technical expert is the only cure.

Me: I have done some research on the Vodafone Forum. Many people have the same problems and most of them cannot be solved. I do not want to waste time.

Service lady: But the Forum is no expert. (sounds kinda impatient)

Me: But my 14-day right of withdrawal will expire this week. If the expert comes next week and the problems still remain, I cannot make the cancelation by then.

Service lady: Your right of withdrawal will be kept till next week. If the expert cannot solve the problems, you can still cancel the contract next week.

Me: Ok then. Please send me the expert.

 

09.03.2020 (Monday) Vodafone sent me a link to make the expert appointment. I made it on Tuesday.

 

10.03.2020 The expert came and checked the cables in my apartment and in the basement. From my point of view, what he has done is only screwing down the interfaces. I am no expert after all. What's worse, the unstable signal and package loss problems are not getting any better.

 

11.03.2020 I received a letter from the service lady/Vodafone. It said, ''So glad that you have reconsidered and withdrawn your cancelation''. I was like, ''What?! I never said that I withdrew my cancelation!'' I cannot upload the letter in the form of a photo so I add it in the attachment.

 

12.03.2020 (Today) I call the Widerruf-Hotline and a serviceman answers.

Me: (after explaining the whole story above) I want to cancel the contract.

Serviceman: Sorry. Your withdrawal deadline is this Monday 09.03.2020. Thus now a cancelation is not possible.

Me: But the service lady said my right of withdrawal would be kept till this week. 

Serviceman: Sorry. That is not possible. You cannot cancel now.

Me: Can I talk to the service lady?

Serviceman: Sorry. She is absent today. What else can I do for you?

Me: I want to cancel the contract.

Serviceman: Sorry. That is not possible. Your cancelation deadline is this Monday.

Me: That is all your fault. I will keep calling until my contract is canceled.

Serviceman: Okay. Go ahead. (Hang up the phone)

 

The whole story makes me feel disgusted. Vodafone only cares about persuading you to sign the contract. They do not give a XXXX about the after-sales service. Now they even trick people into exceeding the 14-day withdrawal deadline. What a shame. I will keep working on this till the cancelation is done.

This is the letter. It proves that I actually did call to cancel the contract. The service lady tricked me into waiting for the technical expert and lied to me that my right of withdrawal would be kept. They are just desperate for sales and numbers with no moral bottom line.
